Jom Mancing Terms of Service

In short: Jom Mancing is a fishing community app. Be honest about your catches, be respectful to other anglers, fish safely, and remember that weather, tide and AI information are guides, not guarantees.

1. Who we are

Jom Mancing (the "app", together with the website at jommancing.com, the "Service") is operated by BAHTERA TECHNOLOGY SOLUTIONS (SSM registration no. 202603289653, old no. 003905211-X), Shah Alam, Selangor ("we", "us"). You can reach us at jommancingg@gmail.com.

2. Accepting these terms

By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Community Rules. If you do not agree, do not use the Service.

3. Who can use Jom Mancing

  • You must be at least 13 years old.
  • If you are under 18, you confirm that a parent or guardian has agreed to these Terms on your behalf.
  • You may hold only one personal account, and you must not use the Service if we have previously removed your account.

4. Your account

  • Give accurate information when you sign up, and keep it up to date.
  • Keep your password private. You are responsible for what happens under your account.
  • Tell us at jommancingg@gmail.com if you think someone else has accessed your account.
  • Usernames must follow our Community Rules. We may reclaim a username that impersonates someone or is offensive.

5. What you post

"Your content" means anything you add to the Service: catch posts and photos, comments, reviews, private and saved spots, profile details and messages to Digital Otai.

  • You own your content. You give us a non-exclusive, royalty-free, worldwide licence to host, store, display, resize and share it within the Service, and to show public posts in promotional material for Jom Mancing (for example, a screenshot of the app). This licence ends when you delete the content or your account, except for copies already shared by others or held in backups for a limited time.
  • You are responsible for your content. Only post photos and information you have the right to share. Do not post anything that breaks the law or our Community Rules.
  • Visibility. Published catches, comments, reviews, your profile and your follower lists are visible to other users. Catches you keep private and your private spots are visible only to you, but we can access them to run and protect the Service.
  • Removal. We may remove content or limit its visibility if we believe it breaks these Terms or the Community Rules, or if the law requires it.

6. Leaderboards and verified catches

  • Catches submitted for a kolam leaderboard may be reviewed by us or by the kolam operator before they appear.
  • We may reject, remove or re-rank a catch if we suspect it is inaccurate (for example, a wrong weight, a reused photo, or a catch from another location).
  • Leaderboard places and badges have no cash value unless an event organiser states otherwise in its own rules.

7. Competitions and events

Events listed in the app are organised by third parties. Their own rules, fees and prizes apply, and any dispute about an event is between you and its organiser. We are not responsible for an event being changed or cancelled.

8. Kolam, shops and other listings

  • Information about kolam, shops, prices, opening hours and stocking times (waktu ikan turun) comes from operators, users and public sources. It may be out of date. Check with the operator before you travel.
  • Any purchase, booking or arrangement you make with a kolam, shop or another user is between you and them. We are not a party to it and do not handle payment for it.

9. Digital Otai (AI assistant)

  • Digital Otai uses an artificial intelligence model to answer questions. Its answers are generated automatically and can be wrong, incomplete or out of date.
  • Do not rely on Digital Otai for safety decisions, legal questions (such as fishing licences or protected areas) or medical advice.
  • Your messages are sent to our AI provider to produce an answer. Do not share sensitive personal information in your messages.
  • We limit how many messages you can send in a period of time.

10. Weather, tides and fishing conditions

  • Weather, tide, moon, sea and fishing-activity information is provided for general guidance only. It comes from third-party sources and our own calculations and may be inaccurate.
  • Always check official warnings from MetMalaysia (Jabatan Meteorologi Malaysia) and local authorities before you go out, especially at sea.
  • Fishing involves real risks, including drowning, bad weather, strong currents and injury. You fish at your own risk and are responsible for your own safety and the safety of anyone with you.

11. Following the law

You must follow the laws that apply to fishing, including the Fisheries Act 1985 and state rules on licences, protected species, size limits and closed areas, and the rules of any kolam you visit. Do not use the Service to plan or share illegal fishing.

12. Premium features

Some features may be offered as part of a Premium plan. If we start charging for Premium, we will show the price and billing terms before you pay, and purchases made through the App Store or Google Play will also follow those stores' terms.

13. Things you must not do

Besides the Community Rules, you must not:

  • break, overload or try to get around the Service's security or rate limits;
  • scrape, copy or harvest data from the Service, including other users' details or kolam listings, by automated means;
  • use the Service to send spam or unsolicited advertising;
  • reverse engineer the app, except where the law allows it;
  • create accounts with false details or impersonate another person or business.

14. Our content and brand

The Jom Mancing name, logo, app design and our own content belong to us or our licensors. These Terms do not give you any right to use them, except to use the Service as intended.

15. Suspending or ending your account

  • You can delete your account at any time in the app under Profile > Settings > Delete account, or by emailing jommancingg@gmail.com. Deletion is permanent. See the Privacy Policy for what happens to your data.
  • We may suspend or delete your account, with or without notice, if you seriously or repeatedly break these Terms or the Community Rules, if the law requires it, or if your account creates risk for other users or for us.

16. Changes to the Service and these Terms

  • We may add, change or remove features at any time.
  • We may update these Terms. If a change is significant we will tell you in the app or by email before it takes effect. If you keep using the Service after that, you accept the new Terms.

17. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free, or that information in it (including listings, conditions and AI answers) is accurate or complete.

18. Limitation of liability

To the extent the law allows:

  • we are not liable for any indirect or consequential loss, or for loss of data, profit or opportunity;
  • we are not liable for anything that happens at a kolam, shop, event or fishing location, or for any deal between you and a third party;
  • our total liability to you for any claim about the Service is limited to the greater of RM100 or the amount you paid us in the 12 months before the claim.

Nothing in these Terms limits rights you have under the Consumer Protection Act 1999 that cannot be excluded, or liability that cannot be limited by law.

19. Governing law

These Terms are governed by the laws of Malaysia. Any dispute will be handled by the courts of Malaysia.

20. Language

These Terms are available in Bahasa Melayu and English. If the two versions differ, the English version applies.
